Mediation – Alternative Dispute Resolution

Mediation is a conflict resolution process that assists protagonists reach a mutually acceptable settlement of their issues. A neutral mediator leads a problem solving process.

 

The process generally involves private pre-mediation interviews with the disputing parties. This is an opportunity to exchange information, outline the mediation process and assess the readiness, willingness and ability of the parties to proceed to mediation. It is important to ensure the parties are clear about their rights, obligations and needs.

 

The mediation process itself involves establishing communication ground-rules, a structured exchange of positions, clarification of needs, generation of possible solutions, an evaluation and negotiation of mutually acceptable solutions, concluding in an agreement and action plan for the parties.

 

Mediation is an option to consider when resolving intense conflicts between two or three people.

 

A wide range of issues is amenable to mediators within organisations using Working Relationships services. For example, issues can range from communication difficulties between two colleagues to dissatisfaction, turmoil and multiple grievances in work units or whole organisations. Our services extend to personal issues outside of work, family conflicts such as those between partners or parents and adolescents, child custody and access or property settlements.

 

For managers, one of the great benefits of contracting an external mediator to help resolve differences, is the opportunity to remain aloof and neutral whilst the mediator works on the process of bringing the people in dispute to a resolution.
